DRIVE INTERNATIONAL. Terms & Conditions

1: APPLICATION. These conditions apply whether or not the contract for private hire service has been entered into as a result of a quotation being offered and accepted or whether the contract has been verbal or in writing.
2: QUOTATIONS. Quotations are made subject to a vehicle suiting the hirer's requirements being available at the time of acceptance. Quotations are based on costs prevailing at the time in accordance with details provided by the hirer, unless otherwise stated. Admission charges, meals, accommodation, tolls and parking charges are not included in the quoted price.
3: USE OF VEHICLES. Unless agreed and confirmed in writing by DRIVE International, the vehicle should not be assumed to remain at any point between the outward and return journeys, neither to remain available for the hirers incidental use when parked at such point.
4: DRIVERS HOURS AND REST PERIODS. The hours agreed by DRIVE International, for the operation of any hire must be strictly observed. Current regulations governing driver's hours and rest periods must be adhered to at all times. DRIVE International reserves the right to curtail or otherwise alter any hire which does not comply with the relevant regulations.
5: SEATING CAPACITY AND SAFETY. The hirer must not load any vehicle beyond the number of passengers legally permitted. Seat belts are regulation and should be worn at all times.
6: ANIMALS. DRIVE International can transport no animal on any vehicle supplied by DRIVE International unless arranged by prior consent.
7: CONFIRMATION. All private and contract hires will not be regarded as confirmed hires until written confirmation of each hire is received by DRIVE International.
8: PAYMENT. DRIVE International must receive all payments for private hire bookings 10 days prior to vehicle hire date, unless alternatively agreed by prior arrangement. Overdue payments will be subject to interest charged @ 0.4% above bank of England base rate per month. Any costs incurred in the recovery of monies owed will be in addition to the total hire cost.
9: CANCELLATION BY HIRER. In the event of cancellation by the hirer DRIVE International. l reserves the right retain and charge 25% of the total hire cost. If cancelled within seven days before vehicle hire date, 50% of the total cost is charged. If cancelled within 48 hours before the vehicle hire date, 100% of the total cost is charged. In addition, any further costs incurred by DRIVE International that were administered by the hirer will be charged to the hirer.
10: CANCELLATION BY DRIVE International. DRIVE International reserves the right to cancel the contract between themselves and the hirer at any time if agreed conditions of the hire contract are changed or altered by the hirer or in the event of any unforeseen emergency that arises out of either the hirers or DRIVE International's control. Cancellation charges will apply (see item 9).

11: ROUTE AND TIME VARIATION. DRIVE International reserves the right to charge in addition to that already quoted, if the hirer detains the vehicle for any time other than that stated in the contract, or if the vehicle is used to travel on `to additional destinations other than stated in the contract. DRIVE International will not be liable for any loss or injury sustained by any passenger who fails to join the vehicle at the appointed time. During all journeys, judgments and discretion to be the sole responsibility of the driver.
12: SUBSTITUTION. DRIVE International reserves the right to provide a larger vehicle than specified at no additional charge will be pro rata to the hire charge. DRIVE International reserves the right to substitute other vehicles (including those of another operator) or ancillary facilities for all or part of the hiring.
13: DELAYS. DRIVE International give advice on journey time in good faith but do not guarantee completion of any journey in any specific time and will not be liable for loss delay or inconvenience caused by the actual time of the journey. DRIVE International will not be held responsible for any traffic conditions or delays.
14: AGENCY AGREEMENT. Where DRIVE International hire in vehicles from another bus or coach operator at the hirers request and where DRIVE International arrange ancillary facilities such as meals, accommodation, ferries, admission tickets or any other service provided by another supplier it does so as agent for and on behalf of the hirer. Any terms and conditions imposed by such other suppliers through Trust line shall be binding on the hirer.
15: PASSENGER PROPERTY. The driver is the sole arbiter as to the carriage of passengers luggage and the storage. DRIVE International will not accept liability for any damage to or loss of any property left on the vehicle by a passenger. All articles of lost property recovered from a vehicle will be held at the depot at which the vehicle is based.
16: CONDUCT OF PASSENGERS. The driver is responsible for the safety of the vehicle. Any passenger whose conduct is a breech of statutory regulations may be removed from the vehicle or prevented from boarding on the drivers authority. The hirer will be responsible for conduct of passengers and any wilful damage caused to the vehicle by the passengers during the hire.
17: COMPLAINTS. Any complaint in respect of DRIVE International should be made in writing to the office within 21 days from the date of vehicle hire.
18: NOTICES. No bill, banner or poster is to be displayed on any vehicle without consent of DRIVE International.
19: WEBSITE PHOTO'S. Many of the pictures presented on our web page depict the actual coaches that are used and will be for hire. However, due to many possible unforeseen circumstances, Drive International cannot guarantee that the coaches used will be the coaches in the pictures. We will however endeavour to provide a vehicle of similar characteristics wherever possible.
20: ENGLISH LAW. This contract is governed by English law.
